Throughout these Terms and Conditions, references to "we", "us" and "our" mean Topiary Garden Limited. References to "you" and "your" mean the person using this website or purchasing goods from us.

These Terms and Conditions govern:

  • the supply and delivery of products purchased from us; and
  • our respective rights and responsibilities.

Nothing in these Terms and Conditions affects your statutory rights as a consumer.

3. Using Our Website

You may use our website for lawful purposes only. You must not:

  • misuse or interfere with the operation or security of the website;
  • attempt to gain unauthorised access to the website, server or associated systems;
  • introduce viruses, malware or other harmful material;
  • use the website fraudulently; or
  • reproduce or commercially exploit website content without our permission.

We may suspend or restrict access to the website where reasonably necessary for maintenance, security or operational reasons.

4. Product Information

We take reasonable care to ensure that product descriptions, specifications, photographs and other information displayed on our website are accurate. However, colours and appearance may vary slightly depending on your device or screen settings. Where manufacturer's part numbers are provided, customers should check compatibility with their existing equipment before ordering, where relevant.

5. Product Availability

All products are subject to availability. Placing a product in your shopping basket does not reserve it. If a product becomes unavailable after you have placed an order, we will contact you as soon as reasonably possible and either: offer a suitable alternative, which you are under no obligation to accept; or cancel the affected item and issue a refund.

6. Prices

All prices displayed on our website are in pounds sterling (£) unless otherwise stated. Prices shown to consumers include VAT where applicable. Delivery charges are shown separately where applicable and will be displayed before you complete your purchase. We take reasonable care to ensure prices are correct. If we discover an obvious pricing error before dispatch, we may contact you and offer you the option to purchase the product at the correct price or cancel your order. We will not be obliged to supply goods at an obviously incorrect price where the pricing error could reasonably have been recognised as a mistake.

7. Placing an Order

To place an order, select the products you wish to purchase, add them to your basket and follow the checkout process. You will have an opportunity to review and correct your order before submitting it. By completing checkout using a button indicating that payment is required, you are submitting an order to purchase the products shown. After receiving your order, we will send you an electronic acknowledgement. The acknowledgement confirms that we have received your order but does not necessarily mean that we have accepted it.

8. Formation of the Contract

Unless we expressly state otherwise, a legally binding contract between you and us is formed when we accept your order and dispatch the goods. We reserve the right to decline an order before dispatch. Reasons may include:

  • a product being unavailable;
  • an incorrect price or product description;
  • inability to authorise payment;
  • suspected fraudulent activity;
  • restrictions affecting delivery;
  • an error in your order; or
  • quantity restrictions applying to particular products.

If payment has already been taken for an order that we subsequently decline, we will refund the relevant amount.

9. Payment

We accept the payment methods displayed at checkout on Shopify. Payment must be authorised before your order is dispatched. Payments may be processed by Shopify Payments or other third-party payment providers. Your use of their payment services may also be subject to their own terms and privacy policies. You confirm that you are authorised to use the payment method supplied when placing your order.

10. Delivery

We deliver to the locations shown in our Delivery Policy and during checkout. Available delivery methods, charges and estimated delivery times will be displayed before you complete your order.

We aim to dispatch and deliver orders within the estimated times shown, but delivery dates are estimates unless we have expressly agreed a specific delivery date with you. Unless another delivery period has been agreed, goods will normally be delivered without undue delay and no later than 30 days after the contract is entered into. Delivery may occasionally be affected by circumstances outside our reasonable control. Please ensure that the delivery address supplied with your order is complete and accurate.


11. Delivery Problems

Please contact us as soon as possible if:

  • your parcel has not arrived within the expected delivery period;
  • the parcel appears to have been damaged in transit;
  • items are missing from the delivery; or
  • you have received an incorrect product.

We may ask you to provide photographs or other reasonable information to help us investigate a damaged, incomplete or incorrect delivery.

Nothing in this section limits your statutory rights.

12. Risk and Ownership

Responsibility for the goods generally passes to you when the goods are delivered into your physical possession or to a person you have identified to take possession of them on your behalf.

If you independently arrange for a carrier that we did not offer, different rules may apply.

13. Your Right to Cancel

If you are purchasing as a consumer, you have a legal right to cancel most online orders without giving a reason. For most goods, the statutory cancellation period expires 14 days after the day on which you, or a person nominated by you, receive the goods. If an order contains multiple goods delivered separately, the cancellation period normally runs from the day after you receive the final item. 14. Our Voluntary 30-Day Returns Policy

In addition to your statutory rights, we voluntarily allow customers to return eligible products within 30 days of receiving their order. To qualify for a return under our voluntary 30-day returns policy, you must notify us that you wish to return the product within 30 days of receiving it;

the product should be unused, undamaged, and in a resalable condition; where reasonably possible, the product should be returned with its original packaging, accessories, instructions, and any other items supplied with it; and you must provide proof of purchase or your order details.

This voluntary returns policy gives you additional rights and does not affect your statutory consumer rights. Certain products may be excluded from our voluntary returns policy where permitted by law. Any relevant exclusions will be clearly stated before purchase or in our Returns Policy.

15. Returning Unwanted Goods

Unless the product is faulty, damaged, incorrectly supplied or otherwise does not conform to the contract, you are responsible for the cost of returning unwanted goods. Returns should be sent to:

We recommend obtaining proof of postage and using an appropriate tracked delivery service.

You remain responsible for returned goods until they are received by us, except where applicable consumer law provides otherwise. If you exercise your statutory right to cancel within the first 14 days, you may inspect the goods in the same way that you would reasonably be able to inspect them in a physical shop. You are responsible for any reduction in value caused by handling beyond what is reasonably necessary to establish the nature, characteristics and functioning of the goods. For returns made after the statutory cancellation period but within our voluntary 30-day returns period, we may require the goods to be unused and in a resaleable condition.

16. Refunds for Unwanted Goods

Statutory cancellations within 14 days. Where you exercise your statutory right to cancel, we will refund: the price paid for the cancelled goods; and the cost of our least expensive standard delivery option, where a delivery charge was paid. If you selected an enhanced or more expensive delivery service, we are not required to refund the additional amount above the cost of our standard delivery service. We may withhold the refund until we have received the returned goods or you provide evidence that they have been sent back, whichever occurs first. Refunds will normally be made within 14 days of the point required by applicable consumer law. Returns made between 15 and 30 days: Returns accepted under our voluntary 30-day returns policy, after the statutory cancellation period has expired, will normally receive a refund of the purchase price for the returned goods. Unless we state otherwise, the original delivery charge is not refundable for returns made solely under our voluntary 30-day returns policy. The customer is normally responsible for the cost of returning unwanted goods. Refunds will be made to the original payment method wherever reasonably possible.


17. Faulty, Damaged or Incorrect Goods

Our 30-day returns policy does not replace or restrict your statutory rights. If goods are faulty, damaged, not as described or not fit for purpose, you may have additional rights under the Consumer Rights Act 2015, including rights to a repair, replacement, price reduction or refund depending on the circumstances. Where goods are faulty or incorrectly supplied, we will not require you to bear return costs where doing so would conflict with your statutory rights.

The important distinction is that days 1–14 are governed by statutory cancellation rights, while days 15–30 are an extra benefit you choose to provide. That means you can reasonably impose stricter conditions during days 15–30, such as requiring the item to be unused and resaleable, whereas those conditions should not be used to override the customer's statutory cancellation rights during the first 14 days.

Ownership of the goods passes to you once we have received payment in full.

19. Manufacturer Warranties

Some products may be supplied with a manufacturer's warranty or guarantee. Where applicable, details will normally be included with the product or displayed on the relevant product page.

Manufacturer warranties are provided in addition to, and do not replace or restrict, your statutory consumer rights against us as the retailer.


20. Compatibility and Installation

Certain irrigation products, connectors, timers, sprinklers, valves, and accessories may require compatible components, appropriate water pressure, or proper installation to function properly.

You are responsible for checking product specifications and compatibility before installation, where sufficient information is provided to enable you to do so. Products should be installed and used in accordance with the manufacturer's instructions. Where appropriate, electrical, plumbing or other specialist work should be carried out by a suitably competent person. Nothing in this section excludes our responsibility for supplying goods that are faulty, incorrectly described or otherwise fail to meet your statutory rights.

21. Promotions and Discount Codes

From time to time we may offer discount codes, promotional prices or special offers. Unless otherwise stated: promotions cannot be exchanged for cash; discount codes cannot be applied retrospectively; only one promotional code may be used per order; promotions may be subject to product or geographical restrictions; and promotions may have an expiry date. Any additional terms applying to a particular promotion will be displayed with that promotion. We will not use these terms to withdraw a promotion after you have already entered into a binding contract at the promotional price, except where permitted by law.

Where our website allows you to create an account, you are responsible for keeping your account credentials confidential. Please contact us promptly if you believe your account has been accessed without your permission. We may suspend or close accounts that are being used fraudulently, unlawfully or in breach of these Terms and Conditions.

23. Intellectual Property

Unless otherwise stated, the content of this website, including text, graphics, logos, photographs, layouts and other material owned by us, is protected by intellectual property rights. You may view and print website content for personal, non-commercial use. You may not reproduce, distribute, modify or commercially exploit our content without our prior written permission, except where permitted by law. Product names, manufacturer names, trademarks and logos belonging to third parties remain the property of their respective owners.

24. Third-Party Links

Our website may contain links to websites operated by third parties. These links are provided for convenience or information only. We are not responsible for the content, availability or privacy practices of third-party websites that we do not control.

25. Our Liability

Nothing in these Terms and Conditions excludes or limits liability where it would be unlawful to do so. In particular, nothing excludes or limits liability for: death or personal injury caused by negligence; fraud or fraudulent misrepresentation; or any liability or statutory consumer right that cannot legally be excluded.

If you are a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms and Conditions or our failure to use reasonable care and skill. We are not responsible for losses that were not reasonably foreseeable when the contract was made. Products sold through our consumer website are intended primarily for domestic and private use unless stated otherwise. If you use products for commercial or business purposes, different legal considerations may apply.

26. Events Outside Our Reasonable Control

We will not be responsible for delays or failures caused by circumstances outside our reasonable control. These may include severe weather, transport disruption, industrial disputes, interruptions to telecommunications or payment systems, natural disasters, governmental action and other events that we could not reasonably prevent. This does not affect rights you may have under consumer law, including your rights where goods are not delivered within an agreed or legally required period.

If you are a consumer resident elsewhere in the United Kingdom, you will continue to benefit from any mandatory protections provided by the law applicable to you and may have the right to bring proceedings in the courts where you live.
